This case is therefore different from Phica, which is still different from the Mia Moglie Facebook group. The real images are only one small portion. Users share shots created with artificial intelligence which they then comment on, often complimenting the degree of accuracy achieved. We’re not just talking about sharing. A section of the site was dedicated precisely to creation of material.
Naked facts with AI, investigations begin after Barra’s complaint: the clue in the site register
The investigation started by the Rome prosecutor’s office is based on crime 612 quater of the penal code. It is a fairly new crime, published in the Official Journal on 25 September. It is the crime of illicit dissemination of content generated or altered with artificial intelligence systems. He is punished with one imprisonment from one to five years. Basically it is not a crime that can be prosecuted ex officio: a complaint from the offended person is always needed but there are exceptions including if it is “committed against a public authority due to the functions performed”.
Where the platform is registered
